5. The tax assessment must have been at least 240 days ago – the assessment of tax liability against you must have taken place at least 240 days before filing for bankruptcy.
If you meet the above five requirements, it is likely that you will be able to eliminate any income tax debt in Chapter 7 Bankruptcy. It is important to note that this does not include secured debts, such as a tax lien.
Tax Debt in Chapter 13 Bankruptcy
Filing for Chapter 13 Bankruptcy is also an option for many people who live in Hayward. In Chapter 13 Bankruptcy, the debtor proposes a three-year or five-year payment plan to repay some or all debts. After the payment plan is over, any remaining unsecured debt is wiped away.
