Filing for Bankruptcy in Newark

The residents and business of Newark have several options available to them in terms of filing for bankruptcy. The two most common types of bankruptcy filings are Chapter 7 and Chapter 13.

In a Chapter 7 bankruptcy, the bankruptcy trustee will sell off, or liquidate, some of your property in order to repay your creditors.

Many people worry that they will lose all their assets in a Chapter 7 bankruptcy filing. While you may have to part with some of your property, California also provides for many property exemptions that will ensure you are able to keep many of your assets including your home.

Once your creditors are repaid, the bankruptcy will be discharged and you will be debt free. The entire process usually takes about six months.

In contrast, if you file for Chapter 13 bankruptcy, you will be entitled to keep most of your property and instead submit to a court-approved repayment plan in order to satisfy all your debts. In order to qualify for this type of bankruptcy, you must have some type of demonstrable income. If then you do qualify for this type of bankruptcy, the repayment period is over the course of three to five years. Similarly to Chapter 7, if you make all the payments over the course of the repayment period, your bankruptcy will be discharged and you will be debt free.
